Terms of Use

The InterContinental Hotels Group RoomService portal, owned by Six Continents Hotels, Inc. ("SCH") and powered by Mashery, is subject to the SCH E-commerce Master Service Agreement for direct Vendors, Agencies, and Media Companies (“Affiliates”) and the Master PartnerConnect Terms and Conditions accepted by Affiliates at the time of application to the program through a network portal. Registration to the RoomService portal is granted in agreement to these same terms and this is a binding and enforceable agreement between Affiliate and SCH (“Parties”). By registering for a RoomService account, Affiliate agrees that Affiliate is affirmatively stating that Affiliate has carefully read and understands the terms set forth in this agreement and Affiliate agrees to be bound by the terms of this agreement.

SCH may from time to time modify these Terms of Use, either by posting the revised Terms of Use at this link or by delivering written notice of such modification to Affiliate. Affiliate use of RoomService following such modification shall be deemed to be Affiliate's acceptance of any such modification. In addition to the terms set forth in the aforementioned agreements, Affiliate use of RoomService shall be deemed to be Affiliate's acceptance of the following terms:

  1. Account Access. SCH in partnership with Mashery shall provide Affiliate with an account name and a password that will allow access to RoomService. Affiliate shall be responsible for any and all activities conducted through its account, whether or not such activities have been directly authorized by SCH.
  2. Lawful Use. Affiliate agrees to use RoomService only for lawful purposes. Affiliate agrees that SCH (in its sole discretion) may monitor any and all aspects of RoomService for the purpose of auditing compliance. If Affiliate or any of its users restricts or inhibits any other Affiliate or user of RoomService, then SCH may, in its sole reasonable discretion, terminate or suspend the right of Affiliate or Affiliate's user to access RoomService, effective immediately.
  3. Affiliate Responsibilities. Affiliate shall be responsible for any failure to achieve volume or other commitments that results from Affiliate’s failure to comply with these Terms of Use.
  4. Other Unacceptable Uses. Additionally, Affiliate may not use RoomService to:
    1. Intentionally or unintentionally violate any applicable local, state, national, or international law, including but not limited to any regulations having the force of law.
    2. Transmit any virus, malicious code, or anything destructive to a recipient’s computer.
    3. Exceed any volume limitations included in the applicable Service Schedule.
  5. Non-Disclosure, Data Ownershop, Privacy and Laws. In addition to, and not in lieu of, any Confidentiality Agreement the Parties may have executed, any marked confidential information and proprietary data provided by one party shall be deemed “Confidential Information” of the disclosing party. Confidential Information shall also include information provided by one party, which under the circumstances surrounding the disclosure would be reasonably deemed confidential or proprietary including, without limitation, the following: (a) business, strategic development, financial, and marketing plans of both Parties; (b) hotel personnel information, customer lists, sales plans, research, and market share information; and (c) performance data, creative, API parameters, user based portal content or proprietry development and coding.
    1. Confidential Information shall not be released by the receiving party to anyone except an employee, or agent who has a need to know same, and who is bound by confidentiality obligations. Neither party will use any portion of Confidential Information provided by the other party hereunder for any purpose other than those provided for under this Agreement. For information that meets the applicable definition of a trade secret and retains trade secret status under applicable law, this obligation shall survive the termination of this Agreement.
